Introduction
Nexgen Electrical Innovations Ltd (company number to be inserted upon incorporation, registered in England and Wales) provides residential, commercial, and industrial electrical installation, inspection, testing, and maintenance services. These Terms and Conditions (“Terms”) govern every contract between Nexgen Electrical Innovations Ltd (“we”, “us”, “our”) and the person or organisation commissioning the work (“you”, “the Client”).
By accepting a written quotation, signing a work order, or allowing us to commence work, you agree to be bound by these Terms. These Terms apply in addition to any rights you hold under consumer protection legislation, which are not affected.
Our Services
We provide the following electrical engineering and installation services across London and the Home Counties:
- Residential installations — consumer units, full and partial rewires, lighting design, sockets, EV charger installation, solar PV and battery storage
- Commercial installations — office fitouts, retail units, distribution boards, three-phase supplies, data and structured cabling
- Industrial systems — motor controls, power distribution, industrial lighting, hazardous area compliance
- Inspection and testing — Electrical Installation Condition Reports (EICRs), PAT testing, emergency lighting testing, fixed wire testing
- Emergency electrical services — fault finding, power restoration, tripped circuits, urgent repairs
- Smart home and automation — smart lighting controls, home automation integration, security systems
Quotations & Pricing
Fixed Price Quotations
Where we provide a fixed-price quotation, it remains valid for 30 days from the date of issue. Fixed-price quotations are based on the scope of work described at the time of survey or enquiry. Any variation — including changes to the specification, access difficulties not disclosed before survey, or concealed defects discovered during work — will be quoted separately before the additional work proceeds.
Time-and-Materials Work
For emergency call-outs or smaller tasks where a fixed price is not agreed in advance, we charge at our current hourly rate. Charges accrue from the engineer's arrival on site to departure. Parking, road tolls, and specialist material sourcing are charged at cost. Our current rate schedule is available on request.
Out-of-hours rates (outside 08:00–18:00 Monday to Friday, and all day Saturday, Sunday, and bank holidays) are available on our rate card. Emergency attendance rates apply where the call-out cannot be deferred to normal working hours.
All prices exclude VAT unless stated otherwise. VAT is charged at the rate prevailing at the date of invoice.
Client Obligations
To enable us to carry out the contracted works safely, to programme and to programme the works efficiently, you agree to:
- Provide clear, safe, and unobstructed access to all areas where work is to be carried out, including loft spaces, under-floor voids, meter cupboards, and distribution boards
- Ensure that instructions to commission or vary work are given only by a person legally entitled to authorise work on the property. Third-party instructions must be accompanied by written authority from the legal owner or their authorised agent
- Disclose any known faults, previous non-compliant works, or unusual features of the existing electrical installation before work begins
- Obtain any necessary planning permissions, listed building consents, or landlord approvals before the agreed start date — we cannot be held responsible for delays arising from missing consents
- Secure any wayleave agreements or third-party permissions required to carry cables or equipment across land not in your ownership
- Ensure the work area is free from asbestos or other hazardous materials before we attend, or notify us so that appropriate precautions can be agreed
Additional costs arising from a failure to meet these obligations — including abortive visits, resequencing of works, or specialist material sourcing — will be charged to you.
Payment Terms
Payment Schedule
- Up to £1,000: full payment due on completion. Invoice is due immediately on presentation
- £1,001 to £10,000: 30% deposit required before work commences; 40% at the agreed midpoint; 30% on practical completion
- Over £10,000: a bespoke milestone payment schedule will be agreed in writing before commencement. Milestone payments are tied to defined completion stages
Late Payment
Invoices unpaid after the due date accrue interest at the Bank of England base rate plus 8% per annum, calculated daily, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. We also reserve the right to claim reasonable debt recovery costs.
Certification and Payment
As per NICEIC Approved Contractor standards, completion certificates (including Electrical Installation Certificates and Electrical Installation Condition Reports) will not be issued until all invoices relating to the works are settled in full. This is a mandatory requirement of our approved contractor status and cannot be waived.

- Bank transfer (BACS) — preferred
- Credit or debit card (via card reader on site)
- Cash (day of completion only, for works up to £1,000)
Regulatory Compliance
All electrical work carried out by Nexgen Electrical Innovations Ltd complies with, or exceeds, the requirements of the following regulations and standards:
- BS 7671:2018 (18th Edition) IET Wiring Regulations — the national standard for all electrical installations in the UK
- Building Regulations Approved Document P (Electrical Safety — Dwellings) — all notifiable domestic work is registered with the relevant Building Control authority
- Electricity at Work Regulations 1989 — we operate safe systems of work and maintain our tools and equipment to prevent danger
- Construction (Design and Management) Regulations 2015 (CDM 2015) — for applicable construction projects we fulfil our obligations as a contractor and, where required, as a designer
- NICEIC Approved Contractor Scheme — we are independently assessed for technical competence and are listed on the NICEIC registered contractor database
Warranty & Guarantee
Workmanship Warranty
We provide a 12-month warranty on all workmanship, commencing from the date of practical completion. Any defect arising from our installation methods or materials selection — as distinct from fair wear and tear, misuse, or third-party interference — will be rectified at no additional cost within this period.
NICEIC Platinum Promise
As an NICEIC Approved Contractor, all our work is covered by the NICEIC Platinum Promise. This provides independent protection for up to six years in the event that our work is found to be non-compliant with BS 7671, irrespective of any change in our trading status. Manufacturer Warranties
Products and materials are covered by their respective manufacturers' warranties. Where a product fails within its warranty period, we will manage the claim with the manufacturer on your behalf as part of our aftercare service.
Warranty Exclusions
- Damage caused by third-party interference, unauthorised modifications, or works by unqualified persons
- Damage resulting from abnormal operating conditions, flooding, fire, or acts of God
- Normal wear and tear on consumable items (bulbs, fuses, cable ties, labels)
- Defects resulting from your failure to follow our commissioning instructions or maintenance guidance
Making Good & Reinstatement
Where our works require the creation of cable runs, inspection holes, or chases in walls and ceilings, we will make good to a reasonable first-fix standard — filling, patching, and re-plastering to a skim finish where required. We accept no responsibility for matching existing paint, wallpaper, tiles, or decorative finishes; permanent redecoration remains the Client's responsibility.
We take reasonable care to protect floor coverings, furniture, and soft furnishings during works. Any damage caused directly by our negligence will be made good at our expense. We cannot accept liability for pre-existing damage discovered during works, or for damage to structures rendered fragile or unsafe by age, damp, or prior non-compliant works.
Health & Safety
We operate a comprehensive health and safety management system. All operatives hold current relevant qualifications and have completed appropriate electrical safety training. We maintain up-to-date risk assessments and method statements (RAMS) for all standard work activities, and site-specific RAMS are produced for any works presenting unusual risk.
You agree to notify us of any site-specific hazards, access restrictions, or health and safety requirements before work commences. Where works are subject to the CDM Regulations 2015 and we are engaged as Principal Contractor, we will fulfil all associated duties including the maintenance of a construction phase plan.
Limitation of Liability
Our total liability to you in connection with any contract — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the greater of:
- The total value of the contract under which the claim arises; or
- The limit of our Public Liability insurance policy in force at the time of the claim
We shall not be liable for any indirect, special, or consequential losses — including loss of profit, loss of revenue, loss of anticipated savings, loss of business, loss of data, or reputational harm — even where such loss was foreseeable. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Intellectual Property
All designs, drawings, specifications, technical schedules, and associated documentation prepared by us remain the intellectual property of Nexgen Electrical Innovations Ltd unless explicitly assigned in writing. A licence to use these documents for the purpose of operating and maintaining the installation is granted automatically on full payment of all invoices.
Cancellation & Termination
Either party may terminate the contract by giving 14 days' written notice. If you cancel after we have ordered materials, commenced site mobilisation, or started work:
- You will pay for all work completed to the date of cancellation, at the applicable contract rate
- You will reimburse us for any materials ordered and not returnable, plus reasonable restocking charges
- You will pay any reasonable demobilisation costs
We reserve the right to suspend or terminate work with immediate effect if: invoices become overdue and remain unpaid after a 7-day notice period; site conditions present a risk we consider unacceptable to the safety of our operatives; or you materially breach these Terms.
Consumer clients (individuals contracting for work not wholly or mainly related to their trade or profession) have the right to cancel within 14 calendar days of signing a contract concluded off-premises, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Dispute Resolution
In the event of a dispute, the parties agree to attempt resolution in the following order:
- 01.Good-faith negotiation — write to us at the address below and we will respond within 10 working days with our proposed resolution
- 02.Mediation — if direct negotiation fails within 28 days, either party may request appointment of an independent mediator through the Centre for Effective Dispute Resolution (CEDR)
- 03.Legal proceedings — if mediation does not produce a resolution, disputes shall be referred to the courts of England and Wales
Governing Law
These Terms and any contract formed under them are governed by the law of England and Wales. Any dispute that proceeds to legal proceedings shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that we reserve the right to bring proceedings in the courts of any other jurisdiction where you have assets.
Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will publish a notice on our website at least 30 days before the new version takes effect. The version of the Terms that applied at the date your contract was formed will govern that contract, unless you expressly agree to the updated Terms.
